SENATE CONCURRENT RESOLUTION NO. 92

Requesting the Joint Committee on Government and Finance study
expanding the powers of the Legislative Auditor to include the
authority to audit private entities in receipt of state funds.
Whereas, The Legislative Auditor is charged with ensuring that
state moneys are used for the purposes for which they were
authorized; and
Whereas, The Legislative Auditor is currently empowered to
audit all public entities to the extent necessary to ensure fair and
accurate disclosure of financial and fiscal operations; and
Whereas, The nature of the relationship between the private and
public sectors is such that a significant number of private entities
receive state money as a part their operating budgets; and
Whereas, Current law creates significant and potentially
unnecessary barriers to auditing private entities for the
Legislative Auditor; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
requested to study expanding the powers of the Legislative Auditor to include the authority to audit private entities in receipt of
state funds; and, be it
Further Resolved, That the Joint Committee on Government and
Finance report to the regular session of the Legislature, 2009, on
its findings, conclusions and recommendations, together with drafts
of any legislation necessary to effectuate its recommendations; and,
be it
Further Resolved, That the expenses necessary to conduct this
study, to prepare a report and to draft necessary legislation be
paid from legislative appropriations to the Joint Committee on
Government and Finance.
